in order to implement the principle of “streamlining administration and delegating power, combining decentralization with management, improving the quality of labor protection articles”, the general office of the State Administration of work safety issued a notice to the general office of the State Administration of 1n order to meet the requirements of “service optimization” and solve the problems found in the process of use, we hereby notify the employer of the main amendments to the relevant contents of the “code for management of labor protection articles for employers” as follows:

delete the second paragraph of Article 7 “encourage employers to purchase and use labor protection articles with safety signs.”

the second paragraph of Article 11 (1) is deleted: “there are human carcinogens in the catalogue of highly toxic substances in the workplace (see Annex 3). When the concentration reaches 1 / 2 of the occupational exposure limit (PC-TWA or MAC), the employer shall equip the workers with corresponding labor protection articles, and guide the workers to wear and use them correctly.”< Article 18 is deleted, and the first paragraph of the original article 23 is amended as "labor protection articles shall be properly preserved and replaced as required to ensure that they are within the period of validity." 1V delete Annex 3 and change original annex 4 to Annex 3 and original Annex 5 to Annex 4 the revised “management standard for labor protection articles of employing units” is hereby re issued and shall come into force as of the date of issuance General Office of the State Administration of work safety January 15, 2018 management specification for labor protection articles of employing units Chapter 1 General Provisions Article 1 is to standardize the use and management of labor protection articles of employing units and protect the safety, health and related rights and interests of workers This specification is formulated in accordance with the law of the people’s Republic of China on prevention and control of occupational diseases and other laws, administrative regulations and rules Article 2 this specification is applicable to the management of labor protection articles of enterprises, institutions and individual economic organizations within the territory of the people’s Republic of China Article 3 the labor protection articles mentioned in this specification refer to the personal protective equipment provided by the employer for the workers to prevent or reduce accident injuries and occupational hazards in the process of labor Article 4 labor protection articles are auxiliary and preventive measures provided by the employer to ensure the safety and health of workers, and shall not replace engineering protection facilities and other technical and management measures with labor protection articles Article 5 the employer shall improve the management system and strengthen the management of the allocation, distribution and use of labor protection articles Article 6 The employing unit shall arrange special funds for the provision of labor protection articles, which shall not be replaced by currency or other articles. The fund is included in the production cost and disbursed according to the actual situation Article 7 The employing unit shall provide labor protection articles that meet the national or industrial standards for workers. The protective performance of imported labor protection articles shall not be lower than the relevant standards of our country Article 8 in the process of operation, workers should correctly wear and use labor protection articles in accordance with rules and regulations and rules for the use of labor protection articles Article 9 the dispatched workers and interns used by the employing unit shall be included in the unified management of the personnel of the unit, and shall be equipped with corresponding labor protection articles. For other external personnel at the operation site, they must correctly wear and use labor protection articles according to the same standards as the workers carrying out the operation Chapter 11 selection of labor protection articles Article 10 labor protection articles are divided into the following ten categories: (1) head protection articles for head injuries caused by physical, chemical and biological hazards and harmful factors< (2) respiratory protective equipment to prevent anoxic air and air pollutants from entering the respiratory tract< (3) eye and face protection articles to prevent physical and chemical hazards and harmful factors from damaging the eyes and face< (4) ear protective equipment against noise, water and cold< (5) hand protective equipment to protect hands from physical, chemical and biological hazards< (6) foot protective equipment to prevent physical and chemical hazards and harmful factors from foot injury< (7) trunk protective equipment to prevent physical, chemical and biological hazards and harmful factors from trunk injury< (8) skin care products to prevent physical, chemical and biological hazards and harmful factors from damaging skin or causing skin diseases< (9) fall protection articles to prevent workers from falling or falling objects from falling< (10) other labor protection articles for preventing dangerous and harmful factors Article 11 the employer shall select the labor protection articles suitable for the protection function and effect in accordance with the procedures of identification, evaluation and selection (see Annex 1), in combination with the operation mode and working conditions of workers, and taking into account their personal characteristics and labor intensity< (1) workers exposed to dust, toxic and harmful substances shall be equipped with corresponding respirators (see Annex 2), protective clothing, protective gloves and protective shoes according to different types of dust, dust concentration, free silica content and types and concentrations of poisons. For details, please refer to the guide to the selection of hearing protectors (GB / t23466) (3) if ionizing radiation hazards exist in the workplace and it is confirmed by hazard assessment that workers need to wear labor protection articles, the employer can refer to the relevant standards of ionizing radiation and the basic requirements for personal protective equipment (GB / t29510) to equip workers with labor protection articles and guide them to wear and use them correctly< (4) for workers engaged in operations involving falling objects, splashing debris, rotating machinery and sharp instruments, the employer may also refer to standards such as code for the selection of personal protective equipment (GB / t11651), code for the selection of head protective helmets (GB / t30041) and code for the safe use of falling protective equipment (GB / t23468), Provide suitable labor protection articles for workers Article 12 if there are different kinds of dangerous and harmful factors in the same workplace, the workers shall be provided with labor protection articles to prevent all kinds of hazards at the same time. The compatibility of labor protection articles that need to be equipped at the same time should also be considered if workers work in different places and are exposed to different dangerous and harmful factors, or to harmful factors with different degrees of harm, the labor protection articles selected for them should meet the protection needs of different working places Article 13 the selection of labor protection articles should also consider the suitability and basic comfort of wearing, and select the appropriate size and style according to personal characteristics and needs Article 14 the employer shall provide emergency labor protection articles in toxic and harmful workplaces where acute occupational injury may occur, and place them near the site with eye-catching signs the employer shall provide personal emergency protective equipment for mobile workers such as patrol inspection< Article 15 The employing unit shall, according to the types and degrees of hazards and harmful factors existing in the workplace, the working environment conditions and the effective use time of the labor protection articles, formulate the labor protection articles allocation standards suitable for the unit (see Annex 3) Article 16 the employer shall make a purchasing plan according to the standard of labor protection articles, and purchase qualified products that meet the standard Article 17 the employer shall check and keep the original or copy of the quality certification documents such as the inspection report of labor protection articles Article 18 The employing unit shall issue labor protection articles according to the equipment standards formulated by the unit, and make registration (see Annex 4) Article 19 The employing unit shall train the workers in the use and maintenance of labor protection articles Article 20 The employing unit shall urge the workers to inspect the labor protection articles before using them, so as to ensure that the appearance is intact, the parts are complete and the functions are normal Article 21 The employing unit shall regularly check the use of labor protection articles to ensure the correct use of labor protection articles Chapter 1V maintenance, replacement and scrapping of labor protection articles Article 22 labor protection articles shall be properly preserved and replaced in time as required to ensure that they are within the period of validity the common labor protection articles should be kept by the workshop or team and maintained regularly Article 23 The employing unit shall regularly maintain and overhaul the emergency labor protection articles, and regularly test the performance and effect of the labor protection articles to ensure that they are in good condition and effective Article 24 the employer shall issue the labor protection articles regularly according to the distribution cycle, and the employer shall replace the damaged articles in time Article 25 safety helmet, respirator, insulating gloves and other labor protection articles with high safety performance requirements and easy to wear and tear shall be scrapped when they are due according to the minimum index of effective protection function and effective service life< Article 26 the working place mentioned in this code refers to the position and working place where workers often or regularly stay while engaged in professional activities or production management Article 27 the management of labor protection articles in coal mines shall be carried out in accordance with the provisions of the standard for equipping personal protective articles for occupational safety and health in coal mines (aq1051) attachment: omitted
